1. Introduction
These Terms and Conditions govern the provision of property photography, floorplan, video, interactive tour, and Energy Performance Certificate (EPC) services by Turn Key Photography, a trading name of PopLil LTD (Company No: 16981036), registered in England and Wales with its registered office at 97 Mays Lane, Barnet, England, EN5 2DX ("Turn Key", "we", "us", "our").
By booking any service with Turn Key Photography, whether online, by phone, by email, or by any other means, you ("the Client") agree to be bound by these Terms and Conditions in full.
2. Booking and Confirmation
All bookings are subject to availability. A booking is not confirmed until you receive a written confirmation email from Turn Key Photography. We reserve the right to decline any booking at our discretion.
It is the Client's responsibility to ensure that all details provided at the time of booking, including the property address, contact details, access arrangements, and shoot date and time, are accurate. Turn Key Photography accepts no liability for losses arising from inaccurate information provided by the Client.
3. Access and Property Preparation
The Client is responsible for ensuring that the property is ready for photography at the agreed shoot time. This includes ensuring the property is clean, tidy, and appropriately staged. Turn Key Photography reserves the right to charge a re-shoot fee if the property is not in a suitable condition at the time of the shoot.
If the photographer cannot gain access to the property at the agreed time, a failed visit fee equal to 50% of the shoot price may be charged.
4. Delivery
Turn Key Photography aims to deliver all edited assets within 24 hours of the completed shoot. While we make every effort to meet this commitment, delivery times may be affected by factors outside our control. The 24-hour delivery commitment is a target, not a contractual guarantee, unless specifically agreed in writing.
All assets are delivered digitally via a secure Google Drive link sent to the email address provided at booking.
5. Pricing and Payment
All prices are quoted exclusive of VAT unless otherwise stated. VAT at the prevailing rate (currently 20%) will be added to all invoices.
Invoices are issued monthly in arrears. For standard bookings, a consolidated invoice covering all shoots completed in the preceding calendar month will be sent on or around the 1st of each month. Payment is due within 30 days of the invoice date.
For block booking arrangements, pricing is agreed in advance and fixed for the duration of the arrangement. Block booking rates are subject to review with 30 days' notice from either party.
⚠️ Late Payment Charges
Invoices not settled by the due date will incur a late payment charge. For every calendar day that an invoice remains unpaid beyond the due date, a charge of 1% of the outstanding invoice total will be added to the amount owed. This charge accrues daily until the full outstanding balance, including all accrued late payment charges, is settled in full.
For example: an invoice for £200 unpaid for 10 days beyond the due date will accrue £20 in late payment charges, bringing the total due to £220. After 20 days, the total would be £240.
Turn Key Photography reserves the right to suspend services to any Client with an outstanding overdue balance until that balance is cleared in full.
Payment reference: All bank transfers must quote the invoice number as the payment reference. Payment details are shown on each invoice. Queries regarding invoices must be raised within 7 days of the invoice date, after this period, the invoice is deemed accepted in full.
6. Cancellation and Rescheduling
Cancellations or rescheduling requests must be made by email to hello@turnkey.photography as early as possible and no later than 24 hours before the scheduled shoot time.
- More than 24 hours' notice: No charge. The shoot will be rescheduled or cancelled at no cost.
- Less than 24 hours' notice: A cancellation fee of 50% of the quoted shoot price will be charged.
- Same-day cancellation or no-show: The full shoot price will be charged.
7. Copyright and Image Usage
Turn Key Photography retains full copyright in all photographs, floorplans, videos, and other assets created during a shoot. Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable licence to use the delivered assets for the purpose of marketing the relevant property via estate agency portals, social media, and printed particulars.
The assets may not be resold, sublicensed, or transferred to any third party without prior written consent from Turn Key Photography.
Turn Key Photography reserves the right to use images for portfolio, marketing, and promotional purposes unless the Client expressly requests otherwise in writing prior to the shoot.
8. Quality and Complaints
We take great pride in the quality of our work. If you are not satisfied with any delivered assets, please notify us by email within 48 hours of delivery, providing specific details of the issue. We will assess the complaint and, where appropriate, offer a re-edit or partial credit at our discretion.
Complaints raised after 48 hours of delivery may not be eligible for remediation.
9. Limitation of Liability
Turn Key Photography's total liability to the Client in respect of any claim arising from the provision of services shall not exceed the value of the invoice relating to the specific shoot in question.
We accept no liability for indirect, consequential, or special losses including loss of profit, loss of revenue, or loss of anticipated savings.
10. Data Protection
Turn Key Photography processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details of how we collect, use, and store your data, please refer to our Privacy Policy.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
Turn Key Photography reserves the right to update these Terms and Conditions at any time. The most current version will always be available at turnkey.photography/terms.html. Continued use of our services following any update constitutes acceptance of the revised Terms.
